KOTA KINABALU: Parti Bersatu Sabah (PBS) fully welcomes and supports today’s landmark High Court decision in favour of the Sabah Law Society (SLS) concerning Sabah’s 40% entitlement under Articles 112C and 112D of the Federal Constitution.
The ruling reaffirms the constitutional and moral obligation of the Federal Government to honour what was agreed under the Malaysia Agreement 1963 (MA63) and the founding principles of our Federation.
PBS Acting President Datuk Seri Dr Joachim Gunsalam expressed the party’s appreciation and congratulations to the Sabah Law Society (SLS) for its steadfast commitment and courage in pursuing this judicial review.
“PBS commends SLS for standing firm on behalf of all Sabahans. This decision is a victory not only for the rule of law but for the spirit of fairness, equality, and partnership enshrined in MA63,” he said in a statement today.

Dr Joachim stressed that the judgment confirms what Sabahans have long asserted – that the 40% entitlement is not a privilege, but a constitutional right guaranteed to Sabah.
“For nearly five decades, this right has been overlooked and delayed. The time has come to correct this historical neglect and to give effect to the constitutional promise made to the people of Sabah.”
PBS calls on the Federal Government to comply fully with the Court’s directives to commence a proper review within 90 days and reach an agreement with the Sabah Government within 180 days on the revenue due for the years 1974 to 2021.
“The Court’s order must be respected without further delay or excuses. Justice delayed is justice denied,” added Dr Joachim.
He further emphasised that this issue transcends politics and should unite all Sabah leaders in safeguarding the state’s constitutional and fiscal rights.
“PBS has consistently championed the restoration of Sabah’s rights under MA63. This judgment is a crucial step forward in restoring that balance within our Federation,” he said.
PBS reiterates its full support for the Sabah Law Society and the judiciary for upholding the rule of law and protecting Sabah’s rightful position in Malaysia.
“Let this be the beginning of a new era of sincerity and fairness between Sabah and the Federal Government. After 48 years, it is time to honour our agreement and uphold the Constitution,” said Dr Joachim.
